We are being taken to court.

What rights (in scotland) does a father have when his name IS on the birth cert?

Crikey - not sure about Scotland - but generally the name on the BC gives Parental Responsibility - this does not give rights to the father but to the child, eg to have both parents involved in their life.

That means parents have to discuss major issues like education, religion etc. Also (I think) name cannot be changed without permission of all with PR.

I think you'd get better advice if you gave more details, TBH.
