At last.

LA has conceded hours and specified OT provision so we can withdraw appeal.

How long before the next fight?

I will try and enjoy this moment.

It's coz they know you'll never let it be if they didn't.

Well done.

Well it doesn't usually stop them pissing me about!

The difference has been the presence and persistence of Irwin Mitchell.

Jolly well done! Delighted for you. Don't crack open the champers perhaps until the actual statement appears but hope you enjoy a good Wine tonight to celebrate.

Got a copy of it! AR in a few weeks and I am sure they will try and unpick again then.

Oh well in that case, caution to the wind Grin

How can they have AR just a few weeks after the statement has been finalised? Confused

Report
StarlightMcKenzie · 14/02/2013 20:43

We had an AR 2 weeks after tribunal settled. I was also Confused, but the LA didn't turn up.

No, it hasn't stopped them so far, but I bloody bet they knew not to chance it without fecking good grounds this time.

Report
StarlightMcKenzie · 14/02/2013 20:44

Because you haven't stopped with the other stuff. Their paperwork stress is probably more than they can stand already.

Transition review.

They were going to force us to Tribunal Star. They had no OT evidence to contradict ours but said 'we'll just argue against you and let the Tribunal decide'. Seriously!

Solicitor threatened them with costs but they have pointed out there is an AR and things can be reviewed so they are probably up to ten tons of crap.

They are too crap not to play it shitty because it is all they know.

They still tried to sneak in changes to the statement after saying they'd accepted all our amendments.

'we'll just argue against you and let the Tribunal decide'.

Yes. That happens a Lo because some panels will rule in favour of the LA no matter what.

I shoukd know Sad

Cost of repeated tribunals (to public purse, never mind to the poor sodding family) is often way more than cost difference of the provision sought. Shame that can't be factored in like transport Angry

An outrage and an abdication of their statutory duty to decide the child's needs for themselves.

Until these tossers face cost penalties for these sort of shenanigans, nothing will change.

It makes the idea of mediation laughable. Delay only ever benefits the LA.

It's worth responding to the Bill on that basis alone and on DPs.

I'd quite like the bill to insist on swearing on oath in tribunals. Parents are too frightened to ask for this but desperately want it.

Absolutely. I haven't read it yet but it would be good to submit something.

Yes. Though, I keep submitting things as an individual and as part of a group. When are we gonna stop weighing the pig?

Well done IE
Ridiculous you will have to have AR but if they change the statement in 2 weeks, anything they change then will make them look wholly unreasonable if you have to appeal again, in fact you could probably get the whole appeal costs as wasted costs if they made you start the whole process again 2 weeks after settling.
Our LA tried to call a transition (from nursery to school) in January 2 months after tribunal we just told them straight out not to be so stupid and how bad it would make them look at the next tribunal and they dropped it.

There is a public reply page to the Bill here and we should do something collectively and / or individually. I'll ask DH about a website again. He can't do a proper one but can do a basic one.

Thanks Agnes. They would make us some lying excuse about change of circumstances!

I agree on trying to do a response, but am facing half term and work overload at moment! Will try and email peeps.
