What should i do regarding SN dds right to education?

My DD has a statement due to various medical problems.The main one being she has a tracheostomy .She started school 4th september and had a teaching assistant .But,at the end of the summer term the TA was off sick so didn't do her trachy training with us.Then the week before DD started school her consultant took us by surprise and removed her trachy.The school decided to keep the TA as her contract was until December.
After just 1 week of half days at school DD had to have her trachy back in.Then when we contacted the school the TA was off sick again.She still is and is now in hospital .
The problem is I have been going with DD every day to do her medical needs and be there just in case.This is the only way she could go.
However DD is due to start full time tomorrow and the school has asked that we only go afternoons.No reasonable explanation and no sign of the TA returning let alone commencing her training.
I am so angry and upset that my DD has to miss the start of primary school and the chance to be with all the other children.
I am phoning the local education authority tomorrow .What else can i do ?
I know it is late but any advice would be much appreciated.TIA.

i am sorry that i can't really help you with this but didn't want you to be ignored.
AFAIK your DD should have someone trained with her, the school should provide someone to meet her medical needs suction and any other stuff that is needed, IMHO schools will often try to wriggle out of this and get the parents to do the job, this is neither right or fair. i would be talking to the school and if no joy then the Lea.
i did work with a girl who had a trachy and she had full time nursing support at school.

I don't really know much about this area either, but it sounds like the school are treating you and DD very unfairly. Only thing I can think of is whether your local Parent Partnership might be able to advise you?

I'm not sure I can help sorry. Have you looked in special needs as well? Really not on to ask you to only go afternoons!

Thanks everyone ,sorry got distracted on the thread about us all being middle class bores.
The only person i have spoken to about this so far is an outreach nurse at the hospital.
She said the LEA may try and wriggle out of their duty to dd as she is not 5 until Jan.
I was really hoping after nearly 5 years of caring to go back to work soon.Am worried that even if the TA eventualy comes back she will always be going off sick.Then what happens i wonder?Also have a 3 y.o who has just started pre school (mornings only) so this is impacting on her care also.
Will let you know how i get on tomorrow and thanks again.

Appointment with SENCO at school + head and class teacher. Contact LEA also.

Hi

School are contravening the SEN Disability Act - School can not exclude your DD for part of the school day due to not having the correct support in place - best thing would be to ask for an interim Annual Review. Also contact the Local Authority SEN Assessment Team and if you want things to happen fast - contact the Principal Educational Psychologist. Good Luck

Hi

My middly has SN and a statment with 20 hrs of 121 at school, and at moment that is all the school will him attend. I rang LEA an got told that he does not have to attend school fultime, till the term after his 5th birthday wich wll be next september.

So what i'm trying to say is how old is your dd and if under 5, then unfortunately they d'ont have to attend full time.

sorry it doesn't help you, but i know how you feel, i was so looking foward to my middly starting school and having a day to myself.

You are right Saz, children do not have to attend school until the term after their 5th birthday, but that does not mean that the school can exclude the child even if just for part of the day due to a special need or disability, not at least if attending part-time is in agreement with the parent, especially if the child has a Statement. Once again I would suggest requesting at Interim Annual Review of the Statement to ensure that the correct provision is in place so that the child can receive the full education he/she is entitled to. I would also be very concerned if the Local Authority support the school in this - if this is so get support from the Parent Partnership in your authority.

Thanks for the advice everyone.DD is still 4 and doesn't turn 5 until 5th Jan.
However the good news is that the TA is out of hospital and ready to start her training next week.
The school also have looked at dds funding and decided to employ an additional TA ,i think incase the first one is ill again.
The training should take about 2 weeks and then DD can at last go full days like her class mates.

They are discriminating against your child and probably contravening what her statement says.
Hopefully the new TA will go well.
