Getting deposit back

Hi all,
We moved into our new place a few weeks ago and have been struggling to reach our old letting agency about getting our deposit back. Does anyone know if it's okay for the tenants to request the deposit back from the scheme directly? I'm worried that the agency is just ignoring us, as they also owe us two weeks rent...

yes, get in touch with the deposit scheme right now if not sooner. (OK, it is Sunday, so maybe tomorrow).

letting agencies are unregulated. Why have yours got your rent? I really really hope they haven't scarpered with it.

I also really hope that the deposit was actually lodged and that you got the prescribed information to confirm that it was.

Hi Natasha,

There is no option on //www.tds.gb.com to request your deposit, only to raise a dispute. Would one have to raise a dispute?

Thanks guys, I will dig out our deposit form first thing tomorrow and see if it's possible to get it back. They've got our rent because we checked out of the flat in the middle of the month, but had paid for July up front through standing order. We've been messed around over that flat (with previous landlords and former letting agents - a bit of a horror story!) so if they try to take that rent I will be on the war path and phoning solicitors...

just to check - as a tenant, you gave 1 months notice to expire on the day you normally pay the rent. Thus if you normally paid on the 1st, your notice would also expire on the 1st.

If you left mid July that may mean you were still liable to pay up to the end of July, unless otherwise agreed.

re the deposit, normally unless the landlord raises a dispute it is returned to the tenant in full after 10 days.
