I work for a supermarket and was told a lot of bull by hr and I'm beginging to think this was too! I had been off sick for about 10 days with bacterial tonsilitis b4 I got pregnant which work covered at full ppay I was signed off at 15 weeks preg and was told they would top up my wages in full for 10 weeks and as I had been off b4 my preg one would be shorter I thought preg related illness was counted seperatly

It's counted seperately in relation to disciplinary action related to sickness or if it would affect chances of promotion etc, but not in relation to company sick pay.

For example, someone might be entitled to 6 weeks full company sick pay, they would onky be entitled to 6 weeks pay altogether regardless of whether the illness was related to pregnancy.

I would double check and get advice though.

I'm pretty sure Waggamamma is right and the 'pregnancy-related sickness doesn't count' rule only really applies in terms of performance managing poor attendance. ie. if you are off sick loads on loads of random occasions, they can't discipline/sack you if its pregnancy related. I think in terms of pay, there are no exceptions made for pregnancy. If you are sick (regardless of whether it is pregnancy related or not) you get paid according to your sick pay entitlement in your contract.

Employment lawyer here and sorry, the above posters are right.

Preg/maternity related absence can't be counted towards disciplinary action via absence triggers etc as they can't put you at a detriment (sorry too much of a headache to go into fine details) but just because you are pregnant doesn't mean your contractual sick pay entitlement is automatically extended. If it's run out due to non preg illness, then it's run out! You are still entitled to SSP though surely?

Hi notkatemiddleton. I hope you don't mind but I wondered if I could ask your opinion on my situation. I've been off work for 5 months due to epilepsy. I was changing meds all year last year and my HR manager said they were going to performance manage me so I got signed off sick which I should have done long before - I have a strong work ethic lol - anyway, so I'm off sick looking at a phases return and find out I'm pregnant. Could this keep them off my back or would they still be able to performance manage when I go back? Sorry for bothering!x
