Can you still claim Child tax credits, even if you don't get child benefit?

Yes you can if no one else is entitled to and claiming it and you have the kids staying with you full or part time.

Though at some point they will check entitlement so you will need to provide evidence.

Not if someone else claims CB as the child's main carer.

They let me. I claimed from Nov right up to march when I finally won the right to claim the child benefit. I had to dispute it the child benefit with my EX.

My mum claimed child benefit and the other benefits for my DS as I was very young when I had him and did not qualify and was still living at home. So she was the main carer while I was studying. But when I wanted to move on to higher education, they establishment wanted proof that I had a child and that I needed to prove that by sending them child tax letter in my name. Obviously I couldn't as because my mum was receiving it in her name. So I called child tax credits, told them my situation and they said as my mum is claiming child benefit, it's up to her if she wants to transfer the child taxes credits in my name, so the child tax people and my mum had a discussion and it was agreed that the child tax credits would transfer to me even though I don't get child benefit

DS and I were living at home at the time. But since I've moved out, everything is in my name now. But was worried recently as someone said you can't claim child tax credits if child benefit ain't in my name. So I got worried as my circumstances were different.

Yes my DS still lives with me as we both have moved out from my mums home.

I said in my previous post, that since I have moved out, everything is all in my name, meaning all benefits are in my name now, including child benefit.

I'm querying about the time I was living at home with DS. Child tax credits was in my name, from the point I was in higher education. Even though my mum still had child benefits in her name.

Thanks. But I'm asking if the child tax people were in the right to let my mum transfer my sons child tax credits to me in my name, at the time when we were living with her. Even though she was still getting child benefit in her name.

I think you should be ok from what you've written. It was transferred with the agreement of your mum and the hmrc. In case the compliance officer contacts you try to get together any evidence such as receipts for things you've paid for for the children, such as food, clothes, clubs.

HMrC criteria states specifically that the receipt of Child Benefit is not to be used in the decision of entitlement to Tax Credits.
