Put a claim in for new cmo as ex not contributing after numerous promises.
He already has 2 children he pays for through old csa system.
He pro longing the claim by asking for dna which I think he has now cancelled having realised he will have to pay for it!
Anyway, he owes arrears and is paying for that on top of his 20% for maintenance (under old system).
He is furious I have made a claim and is demanding I cancel as they will now take 55% off him as my child makes no. 3 plus the arrears.
Is this possible? I thought csa/cmo could only take 40% off a NRP's income.
He insisted they told him they will take 55%, but I think he is lying in a attempt to try to get me to cancel my claim.
He wants a private arrangement "all of a sudden" but I don't trust him.

So is 55% off a wage for 3 children plus arrears possible?
& if has old claim via csa, I've been told my claim will bring over to the new system. Does that mean he will pay less and the other mum will get less now as percentage per child has now changed under new system...
This is all a mess!
If anyone knows, please help.

Also if I opt for the collect and pay, will the new 20% fee be added on top????

I thought it was 25% and split among all children. But could be wrong.

The fee charged to him is on top and the fee charged to you is out of the maintenance. That's what they told me when I rang the other week anyway.

See that's where I'm confused...
They told me it was now 19% for 3 children (used to be 25%). But I think he is paying 20% under old system for 2.
So when his acc moves over to new system due to my claim is it then 19% for all?
Then do they add his arrears for previous 2 children on and new 20% fee on top?

I think the new system is 19% of net income - ie after tax, instead of 25% of gross income - comes to about the same though - a bit more if your ex is a high earner, a bit less if he earns not very much.

So you'll get a bit over 6% of his after tax income, or the one of his 3 children that's yours. I'm not sure what they do about the arrears - add them on I assume - they won't recalculate waht is owed just because of the new system

It's the other way round. Previously 25% of net, now 19% of gross minus pension payments.

Arrears are on top of that.
