CSA Tribunal

Hi,

Has anyone any experience with the Appeal process with CSA? My children's dad is appealing the CSA's maintenance payment assessment. They have already deducted significant travel expenses in the calculation but he still doesn't agree with the amount!

What is the likelihood of the appeal to a Tribunal being granted? And if it does go to a tribunal, how likely is it that they would change the maintenance assessment? How long could this whole process take?

It has taken my friend 5 years and is still going on despite the secretary of state going against my friend's ex's appeal !!

Whow, that is a long time. It's terrible but I suppose that hopefully the result might be that at least I get something!. betterthanever, did your friend have any arrears given to her in the interim?

No she didn't they are currently £18,000 and rising. At one point he even stopped the basic low payment.

My children's dad hasn't paid even the basic maintenance for 8 months now & sitting at approx £2,000 in arrears. Did your friend's ex not get sent the criminal avenue for the non payment of arrears?

Her ex knows how to work the system, when she claimed that he was not be honest about his income he had claimed a change of circumstances which was proved to actually be diversion of income at a tribunal, the arrears were then calculated at £18k. He keeps appealing and changing circumstances again. He knows the `change of circumstances' route delays things. But he is running out of appeal options.

Well, I'll just keep battling along. Will never get my head around why a parent would not want to contribute to their children financially, but obviously there are a lot of miserable selfish people out there!

They justify it to themselves as they see it as not giving the mother the money. They can't seem to distinguish between the two.

My ex knows exactly how to work them too, agrees to pay 500 on the day it should cone out he rings up to make less than his actual amount he should be paying not including arrears, he doesn't type his dob or ni number in and gets transferred to a call centre who just take payments he then says I will pay the rest by the end of the month, then the next payment becomes due he pays a tiny amount and agrees to pay 600 the following month then follows the exact same process, I ring on a weekly basis and they 'have to give him the benefit of the doubt to pay it' they say if he doesn't pay next time it will go through his wages it can go months and months with not a penny and nothing ever gets done! He was supposed to pay 600 on the 1st and iv just recieved a txt saying I 200 has been sent by csa, I never axpect anything now I used to rely on it but I have learnt that if I don't expect it, then its a bonus and I know one day he will have to pay it all back whether that means him still payin when daughter is 30 then so be it! Useless and disgraceful I can say allot of sentances starting 'he can't afford csa but yet he's there doing ....' It's a joke how they can still have the time to work full time and enjoy the money it pays but we are the single parents who have to scrimp and save because they are so mean and heartless, one week I couldn't afford shopping and my daughter had to live off nasty processed food for a week n he was living it up on a weekend away! I have lots of isuues with this subject can u tell lol :)
