Party Wall Act 1996

Briefly: we live in a row of terraces. Our immediate neighbour is having her loft converted and has told us, though we have seen no plans, that she is having her kitchen extended and a sunroom added.

Even if the above is allowable under Permitted Development, should we have been notified under The Party Wall Act?

If we should have (and we haven't) what do we do now?

It depends if she intends that the wall or its foundations are going to be partly on your land.

The foundations would be within 3 m of us, as she intends to run them along where a fence is currently. The fence is about 30 cm from the boundary, as a shared passage way runs between our houses (we own half each and the boundary is down the middle with a ROW for others in the terrace).

Doesn't sound like it's going to be a party wall. There may be a temporary disruption to the ROW though.

Yes, you should have been notified. The loft conversion (unless done quite unusually) will be taking support from the party wall, therefore a notice is required.

In addition, the new foundations will be within 3m of your foundations therefore you need to ensure that what she has planned doesn't undermine your footings.

If you can find a local party wall surveying company, give them a call and ask what you need to do to get an award in place.
