Phone insurance

Hi I wonder if any of you could help. My sister aged 16 was at the beach last week and had all her belonging in a bag, her make up, clothes, iphone, phone charger, her friends ipod and other things. Her and a friends shoes were under the bag and their coats on top of the bag. They were paddling in the water about 2 metres away from their stuff and were continually checking their bags.

All their stuff was stolen, the bag, the coat on top of the bag and the two pairs of shoes under the bag. They had to ask some passers by to use their phone to call home and then had to walk off the beach on the rocks and stones barefoot. Their feet were cut to pieces!

Once we found out she had lost her phone, we went on her account and tried to track the phone, which said it was offline. A friend of hers tried to facetime the phone and someone answered then hung up. (they must have taken out her sim and put a new one in) I put the phone to have a message with my phone number to call but no one did. She reported it to the police that night and had the phone completely blocked the morning after. The police recorded it as a crime and she has a crime reference number.

Her father reported it to the insurance company the morning after. We are still awaiting their decision and it has been 5 days. They now want to speak to her to clarify a few things. What are her chances of getting a new phone under the insurance? Her father thinks they are going to decline under negligence :(

It depends whether it was insured all risks or not. All risks she should be fine. If not all risks they probably won't pay out as it was unattended.

It was insured for theft, as far as I am aware for loss to. It wasn't insured with the network company. He found cover elsewhere to get it cheaper.

That is what her father thinks, they won't pay out as it was unattended :(
