i need som e advice, as i dont know where to go next?!? i worked part time for a company in the summer, as i temp, but it wasnt working out as my 3 children were going back to school so i left with not much notice which they were happy with. When they paid me a final salary some 2 weeks after i left they claim they over paid me £200, i dont agree! i agree they paid me £60 over. I wrote to them and they agreed my caluclationd of the hours they paid me but still say they over paid me??? im now getting frustrated, and worried as they have written to me demanding their money back. What are my rights?????

Have they set out the reasons why they think there is a discrepancy between your calculations and theirs?

If they have overpaid you in error they are entitled to seek a return of the money, but you are also entitled to offer a payment plan - eg £1 a week! Grin

They say they paid me till the end of the month, when I left in the middle of the month, however I was a casual worker so paid hourly, I worked out the hours I did, which they agreed but they still claim to have overpaid me ? By my calculation of hours and hourly rate the wage was correct but they keep insisting it wasn't ????!!!!! Even if they do offer a payment plan I'm not paying back what I earned !! Do I just keep sending them my calculations and insisting ??

Can you prove what they have actually paid? Was there an agency involved?
Do you have any paperwork that backs what you are saying?

There was no agency involved , they employ casual workers in the summer as its their busy time. I have paperwork that agrees the hours I worked and the hourly rate I was due, as they have already agreed the hours I worked in the period . But for some reason even tho they agreed the hours they still say I was overpaid as they didn't pay me by hour they paid me a salary ?? But If the hours are correct then th pay is correct surely ????

Are they having trouble due to the annualized hours? Total hours worked in a year divided by 12 gives you your monthly salary. Are they working it out from there? Has your holiday pay been included?

You may find it more helpful in employment issues.
