heard alot of hype about this last year my partner divorced his wife no big deal they didn't have any big assets so now if we ever get off the poverty line and get a mortgage and make steps towards owning our own home does he need to take out this final resolution thing? surely when she chucked him out years ago we wont owe her anything?? i dont want to invest in things if thats the case and he should take this out.

What country are you in? Do you mean a clean break order? Did he have any children with her? How long were they married for? What do they both earn? When did they separate, and how long did they live together for?

(Shift key for caps. Sorry to be a pedant)

My exH came back with a solicitors letter after our divorce when all proceeds of house sale had been concluded etc...demanding money that my DB left me in his Will. We had been living separate lives in our home then exH left and the next day my DB died suddenly. I assumed when we divorced there could be no comeback at all but there was no 'this is full and final settlement ' clause in it, so he was able to lay claim to this money. I'm not sure of the cost of the final resolution order you mention but I don't imagine it would be more than £85?? Which in my experience would have been money well spent !! I would have had no problem with him having the money if he put it to good use but he wasted it good and proper and has nothing to show for it now !!! Hopefully you won't be in such a position but often it's better safe than sorry.
