ex stole kids - what happens with tax credit etc?

not main concern, but, sorting things til court on 6th.... can he stop them? i am sure i have full cust as he has applied for temp cust (hearing on 6th where solicitor hopes to get kids back)

Your tax credits depend on your circumstances. You are supposed to contact them when your circumstances change but in your case your current situation is temporary and you have had a reasonable expectation that your children would be returned to you at any time.

All I can say is, try not to worry about this right now. Hopefully it will be resolved at your hearing on Tuesday (not long now) and there won't have to be any adjustment. Speak to your solicitor about it on the day.

If he is on the birth certificate (which I assume he is as otherwise you could just go get them) and you do not have a residency order in place in your favour, then you both currently have joint Parental Responsibility. If you had full residency, he would not be able to keep the children without your permission. He has applied for temporary residency, which basically will mean he will get full residency until everything has been investigated thoroughly and a final court order made. Good luck, hope it all works out for the best.

Eek meant to say you don't need to worry about tax credits, this may actually be discussed by your solicitors anyway. OH shared child benefit with ex as they had temporary joint residency of my two SS (despite her never seeing them). When it got changed to full residency so he applied for his other child too.
