Potential totting up ban

Please don't turn this into a flaming.

DH thinks he may have got another 3 points, which would take him up to 12. I am furious to say the least.

He drives an awful lot for his job and will lose it if he loses his licence.

I don't want this to turn into a 'he's speeding, he deserves it thread', I just want to keep our house Sad.

Is there anything to be done? Will he definitely lose his licence?

I think if you rely on your licence for your job you can plead for an extension but he'll get a hefty fine

A relative managed to avoid a ban by explaining it would affect his job, his contact with his children and his child maintenance.

Would losing your job count as exceptional hardship? Would there need to be anything else?

He drives a lot for his job? Jut is his job actually a 'driving' job? Taxi/lorry/bus driver etc?

Cos otherwise then it will be assumed he can use public transport

He is a sales manager. So national site visits, many nowhere near public transport.

Hi, the legal position is that he will have to attend court, where the magistrates will proceed to disqualify him as a totter (min 6 months) unless he manages to plead 'exceptional hardship' and they accept his plea. Exceptional hardship would usually be considerations such as disabled relative dependant on driver for transport, child of school age dependant on driver as no appropriate public transport available, car essential for contact with non-resident child, driver sole carer for elderly parents etc... The fact that the driver may or will lose his or her job ( even a driving job) as a result of the disqualification is NOT a reason to find exceptional hardship. He should discuss the effect of a ban with his employer and attend court with a letter stating the position. Many employers will find other work for key employees or build in periods of unpaid leave.HTH
