If my marriage breaks down and we decide to seperate what does my husband have to pay towards? I work 16 hours a week, we have 3 children, aged 5, 2 and 5 months. We have only been married for 3 years though. Our home is in my husbands and his fathers name, therefore will I be forced to move out? Am not leaving without my children.

You need to go and see a family law solicitor as soon as you can. Take copies of all the financial documents you can get your hands on - mortgage, deeds, any savings etc - as well as his and your salary and pension details.

Crikey Daisy! You'd expect to spend 30-60 minutes with a solicitor before they can even begin to answer the question you ask.

CSA would make him pay 25% of his income for the children, though he can deduct one-seventh for every 52 nights of the year they stay over with him. Everything else you get depends on all the circumstances of your case, as set out in s25 of the Matrimonial Causes Act.

Generally your need for housing comes top of the list, as you have the children to look after.
