URGENT help please, need to get injuction

Against ds father. went to court 2 years ago as he threatened to kill me over csa, somehow he got off with court fine and conditional discharge.

csa have now contacted him (ive not spoke to them since last aug) as he's just got a job. had 4 nasty, insulting text msgs off him over csa (not threatening) and also 2 weeks ago he turned up at house shouting and swearing ovrr ds's toys at his parents house. he scared ds and myself. ds is only 3 and has autism .

police just came. rang them tonight as was in london sat when he text. police said need to contact citizens advice and get court injuction asap, ie tomo.

has anyone experienced this please? im shaking like a leaf as wasnt expecting police tonight and tthey could see my fear. i thought it was him back. i only work 19 hours a week as a ta so dont earn much but too many hours for income support. is it likely to cost a lot? thanks

I think that legal aid is available for this kind of injunction even if you earn too much for income support or other benefits.

Women's Aid have a 24 hour help line which might be good to talk to now?

Police are crap suggesting you go to the CAB. You need a solicitor. Don't delay. You should be able to get a non-molestation order.

thanks shall i skip cab then? i rang womens aid who put me through to a more specialist d.v line thats 24 hours but noone available :( its so hard to talk in day as i have ds who has autsm and it makes conversation practically impossible.

You may qualify for legal aid, they may have sent you to CAB as someone in CAB may be able to check if you do.

But even if you don't, most solicitors offer a free half an hour first appointment.

thanks had a free half hour appointment with a solicitor last aug as he was being a pain then. she said he has no legal right to see ds as not on birth cert. googled solicitors used and they dont have good reviews/feedback. his solicitor is known to be best around :(

wish i could move far away but cant leave my parents and have battled and won ds a place at a specialist autism unit to start sep, places are like gold dust :(

You don't need the best in town solicitor for an injuction order. Really.

Skip the cab. You'll wait weeks for an appointment anyway. There is no upper income limit getting legal aid for an injunction.

if he turns up near house again call police - if they arrest him they can give him caution and anti-harassment order to keep away - but rather than wait for this to happen see any solciitor about applying for injunciton or if you can go to local court ask there which papers to fill in. or call them.

if you gone thru CSA you acknowledge him as father so he could go down route of applying for PR - but dont worry about that at this stage.... you coudl give reasons why he should not have PR

Cestlavie, PR is not what is used to be. He only needs to request it, as long as he is the dad, he might get it without much delay.

With regards to the police... IME they are good at holding your hand but moving from caution to actual arrest... don't hold your breath. May take years. Go for the injuction order asap.
