Bank Holiday entitlement and Part Time working

I work part-time (21.5 houts per week) including a half day on a Monday. My friend also works the same hours as me but for a different employer. She has her bank holiday entitlement pro-rata'd and the hours she doesn't get to take (as she only does monday mornings) added to her anual leave entitlement.

Is this a 'perk' or a legal entitlement?

...she thinks its do do with not descriminating against part-time employees.

Are there any employment guidelines anywhere?

There's no statutory entitlement to time off for bank holidays. So if the employer offers it, it's agreed in the contract, not required by law. I guess that if an employer offers time off for bank hols to full timers they should offer a pro-rata equivalent to part-timers (as an employer you have to treat p/t workers the same as comparable full time colleagues).

Wow! I didn't realise this :

"If full-time workers get paid leave on a public holiday, part-timers who don?t normally work on that day have the right to paid time off on another day, proportionate to the hours they work."

I work part time Tue-Fri so I never benefit from Bank holidays but it seems that us part-timers should be claiming for it!

The only contract I have ever signed with this company is my old full-time pre-children one and that states that I get paid for bank holidays so I feel an e-mail to HR coming on.

..should make up for the 2 days unpaid parental leave I had to take last week.

I work PT Tues-Fri so rarely hit a Bank Holiday. Instead my BH sahe (I work 0.5, so get 0.5 of all BH) are added to my annual holiday allowance, to take when I want. Obviously if Christmas, etc. falls on my work days then one must be used to cover those.


When I was teaching, I wored the same days. I never got any extra allowance to cover BHs. If a BH was on my work day, fine - I was off that day. If it fell on my non-wrk day - tough, no extra day off for me.

i work thur and fri 17.5 hours, i'm given my holidays pro rata does that me i should get extra for all the bank holidays that landon the days i don't work?

I think in most big companies, if you work part time you do get holiday hours which include a BH entitlement, but you get to choose when to use them if the BH days aren't ones you normally work on, iyswim.

Dozeynoo, does your friend actually get more hours annual holiday than you?

Yep. More hours anual leave, plus the bank holiday bit on top.

I work in a small office in the UK (10 of us if everyone is in) and HR is in the USA. Both myself and the other lady work part-time. There has never been any issues re part-time we just need to point things out to HR occasionally.

yeah it also works the other way - I am working Mon-Wed and so although I 'get' most of the bank hols, I am only entitled to half of them.

so over christmas when there are 3, I am only entitled to 1.5, but its not like I can go into the office on those days, so I have to pay them back out of my annual leave

I work in an ancient university which is particularly good to p-timers I think. I work Mon - Wed. I get all Monday holidays as they are deemed to be statutory and thus I am entitled to them regardless of my status as part-time; the same applies to the days when it is closed between Christmas and New Year. My annual leave entitlement is calculated on a pro rata basis on the leave year additional to stat and closed days.
