boss hasn't been paying my national insurance

i always thought my boss was a bit dodgy but things are really coming to the surface.

i have worked there for nearly 11 years, get paid by cheque weekly with handwritten payslip attached.

i got a letter from student loans company about a month ago stating that they had been advised by HMRC that i was no longer in employment and was i overseas. obviously this was a terrible shock. i presented the letter to my boss and gave him a photocopy of the letter - he looked incredibly shifty and said it seemed very strange and they must have made some mistake. so i just filled in the form to state that i was still in employment and sent the documents back to the student loans company.

i rang the nation insurance helpline and asked for a statement for the last 10 years and i received this in the post yesterday - it stated that i haven't made any NI contributions for 4 years and stated on it that i owe approx £700 per year for the last 4 years. this is written on my payslip and so i was under the impression that his has been paid. my boss is obviously not putting me through the books which frightens me, but also puts me in an extremely awkward position and now i'm going to have to approach him with this letter...i am assuming that it's him that needs to pay this and not me??

anyone have any advice on how i should bring this up? i am thinking that i just give him a copy of the NI statement and wait to see what he says? it's a very small company with no payroll / HR department...just the boss and us slaves!

Assuming it's been deducted from your gross pay then he absolutely needs to pay it since he's pocketed it!

He is breaking the law so he could be fined and/or imprisoned for fraud. It's up to you how you deal with it. You could ask him to pay the NI that he should have paid already under the threat that you'll be informing HMRC that he's defrauded them.

Ask him to check which Nino he's been paying it under and if he can put in writing how much has been paid. That way you can show the NI office they've made a mistake. Bit less confrontational that way.
In reality, he hasn't paid it and company will probably fold when he's asked to pay it. Has he been paying your tax?

Either way, start looking for another job!

If you go to him and tell him to pay up or you will have to inform the NI - they will go in with a fine tooth comb and tear everything apart, it will not be just your NI they look at but everything and anything going back (his life will be a nightmare from start to finish)

I would though look at the reality - you need to start looking for another job - sorry

yes unlikely to be "just" your NI - income tax, business rates, VAT...

Thanks girls, yes I went for an interview last week, still waiting to hear. Got my fingers crossed that I can get out if here. What a complete crook.
