Are part time workers legally entitled to time off at bank hols?

I work 3 days a week one of which being a tues. I have been informed today that i have been rotated in to work new years day.
I will receive no extra pay for this.
I was under the impression i was legally entitled to take time off at bank hols but would need to use a days hol (which i am fine with)
Work have now said they need me in and if i do not show i will get a disciplinary.
Does any now what part time workers are entitled to?

What does it say in your contract? If it says that your annual leave is x days including bank holidays that fall on your normal working day then yes you should be entitled to it. If it doesn't mention bank holidays then probably not.

No one is legally entitled to either additional pay for bank holidays, or to actually have those days off - it really depends on how your contract is worded.

Your annual leave should, however, include an allowance for bank holidays (equivalent of 5.6 weeks/year pro rated).

If you get allocated a day's holiday in lieu (ie. your leave includes allowance for BH's) but are contracted to work Tuesdays then I'd suggest that you could reasonably expect to work either Christmas Day or NY Day this year and take leave for the other. Part timers should not be treated differently to FT employees so if they have the option to work or use a day's holiday so should you. Seems very late to sort this out though.

There is no automatic right to time off on bank holidays. Refer to your contract/staff handbook as your contract may mention things about holidays, rotas.

I not a extra pay im bothered about - im wondering whether i legally have to choice to take a bank hol off and not be made to work it. I will check in my contract. Thanks for your replies Xmas Smile

I agree that there is no legal right to take a B/H I'm afraid.

Nothing to do with being part time. Either your contract allows your employer to rota you for bank holidays or it doesn't. If they are open on bank holidays I wouldn't think you would be allowed to insist on taking them off.
