I posted recently but situation has become more complicated so need some expert advice please! I was working as a trainee (payments made to my employer by training body for my salary) but my contract ended the week I qualified for SMP. I thought I wasn't entitled to mat pay so just planned to apply for maternity allowance then realised and contacted my employer.
Unfortunately they had issued my p45 and taken me off payroll already. The training body have said they will see if I am entitled to enhance mat pay but will have to reinstate me as a trainee but on unpaid leave until maternity leave starts. They wouldn't expect me to work the 3m afterwards as my trajnjnf has been completed.
I'd obviously be pleased to get enhanced pay but have been offered some work in next 2 weeks and am not sure i would be allowed to work if I'm supposed to be on unpaid leave! Can they restrict me from working in this way?
