Hi all,

I have a sales job with a basic salary and a monthly sales commission. I get 0.5% of what I bring in monthly then in November every year 0.5% of what I have brought in over the course of the whole year.

Payslip arrived today.... no big commission. The rest of the sales staff have the same. No one is willing to answer any questions about it.

Is there anything I can do legally? Do they HAVE to pay this at the same time every year? Should they have written to us if this was not going to be paid?

Any help would be much appreciated!

Is this written into your contract? When you say no-one is willing to talk about it, who have you spoken to? Line manager, HR? Has anyone been approached formally about the lack of commission?

It is in my contract.

Asked my line manager, he has asked HR. HR came back saying it had not been calculated and that we would have to wait until 23rd December to get our payment...... not impressed!!!

Ah, not great then, but not breach of contract. I have known that situation happen in the past where there has been some discussion or difficulty over whether a sale has completed within a particular period, paperwork all been signed off completely, that kind of thing. It would obviously have been better if someone had thought to inform the sales team in advance though. Does your company have form for this kind of thing or is this a one-off?
