... 2 disputes open for one item?

I purchased a jacket. Seller didn't send or answer my emails for 2/3 weeks so I opened "item not received" dispute.

Seller then sends jacket but it's not as described.

If I close "item not received" dispute, can I then open a "not as described" dispute?

This is most annoying.

Any advice much appreciated.

As far as I am aware if you close your not recived dispute you can't open another one for not as described. Was it sent recorded or tracked? If it wasn't i'd be tempted to keep it open untill the seller agrees to refund or part refund.

I've tried contacting seller on more than one occasion and have had no response.

I only have until midnight then the dispute will automatically close and I'll be stuck with a jacket I don't want.

Did you pay for your item using Paypal? If so, open a dispute with them. You'll get your money back.

If not, go to the Help section at the top right of page and do a search.

Does the seller have a returns policy on the description of the original item for sale? You will find that sellers now HAVE to offer a 14 day cooling off period and accept all returns. New ebay policy.

Yes, john, I paid with Paypal.

But, I already have a "item not received" dispute still open. Seller did eventually send item.

Do I close that then open "item not as described"?

If you only have untill midnight tonight and the seller has not responded to the dispute, paypal will end it and find in your favor anyway. Then you can just bin the jacket or charity shop it.

If you've received the item, then it should be closed first.

Then open item not as described, email the seller and say you want to send it back. If no joy there and or they start being funny buggers, just moan to Ebay customer services and start a Paypal dispute.

The seller does have a legal obligation to accept your returns.

You can not open a second dispute for the same item. You CAN change the dispute to sig not as described but not sure if you can do this so close to end of dispute. If item was sent trackable all seller has to do is give this number to paypal who will say they have sent it, end of. Once the dispute is closed it CAN NOT be reopened. What is wrong with it that it is not as described?

if they didn't send trackable then escalate to a claim, get your refund then return the item
