Won expensive phone, screen broken, what next?

I bought an iPhone for my daughter for Christmas, it arrived with a broken screen, also the case is broken. Seller says phone is fine, no breaks but will refund.
What do I do...

  1. ask for refund before returning
  2. return and hope I get a refund

    I have tried to use ebay chat, but it is unavailable Confused

    I am worried that I won't get the money back (£295), seller is not very communicative, doesn't give me a lot of faith, especially as I asked if the screen was marked scratched and didn't get an answer.

return with proof of delivery such as special delivery or courier with adequate insurance. Standard recorded delivery is not adequate and only insures up to £41

if I were you I would open a not as described case in ebay via the resolution centre - send it back when ebay tell you to once the case is escalated, give ebay the tracking number and you will get a full refund. A good seller will also refund you your return postage costs.

I don't know if I would trust an ebay seller buying a second hand phone to be honest - so many scammers.

I have opened a case with eBay, seller has just responded, asking me to send back so they can check if it is the the phone they sent out....I have a nasty feeling about it. I won't be stupid enough to buy another phone on eBay :(

well there isn't much the seller can do - as long as you prove it has been received by the seller ebay will force them to refund you.

You aren't stupid to buy a phone on ebay - unfortunately phones are a high value item which many will scam people over. Not all phone sellers are bad, but I would be v wary I must admit.

I can't see a way to escalate the case as the seller has replied....should I send it special delivery tomorrow?

you have to wait 8 days and then the escalate option will be there - unless the seller themselves escalates it. When ebay tell you to send it back they will email and give you the address - then you input the tracking info into the dispute.

Sorry to be a pain, so should I reply and say I am not happy to send it back until eBay tell me to, or just sit back and wait the eight days?

I would reply in the dispute that you will return it when ebay tell you to. It is a pain to wait but is worth doing it by the book. The seller themselves can escalate the dispute now if they wish.
