Bought a BNWT board game when delivered it was very obvious it was not new

I bought a board game for DD. The board game was BNWT.

When it came the game had scratches on the box, the game stunk of smoke, the board had a big scratch on it, none of the packaging was with the game.

Basically not new most likely used. If it was said to be used I wouldn't have bought it especially for the price.

If I return it does the seller have to refund both postage?

they should give your return costs, but there is no way you can enforce it. You are entitled to your original payment in full. Make sure you return with a signature.

They are not happy with refunding.

I have opened a case and the seller is trying to say the game was BNWT when it left them (There is more problems then just the wrapping missing), if the wrapping wasn't there but all of the pieces were right I would leave it) Now the seller is trying to say I am harassing them since I said I have photos of the damage to the game and the missing pieces.

They have reported my case to Ebay.
What is the possible outcome for this? we have a game that is unplayable and they wont refund us. AngryAngryAngryAngry My DD really wanted this game and she can't even play it.

once escalated ebay will tell you to return it trackable and once you have given them that info ebay shall refund you in full, and then you can leave appropriate feedback and stars.

What has the seller reported you for??

The seller wont say they just said "I have reported this case and this is harrassment" Confused

All I did was open a case and answered the sellers question.

Also is tracked the same as Special or is there another delivery I can pick? I've never had to open a case or anything before. Just this seller.

Since I've opened a case a few other buyers seem to have the same problem with their items.

recorded only is tracked once the item is delivered, and of course if the postie gets a signature. Special Delivery is more expensive and the item is tracked throughout the delivery in stages.

I escalated the case today and Ebay has refunded me.

I don't need to send the game so will it be safe to throw out? It's not playable so pointless keeping it.

Since I won the case and Ebay refunded me I have been getting message afer message saying if I don't refund the seller or return the game. The seller will report mr for abusing the buyers protection.
What does the seller mean?

I have also recieved messages telling me to change feedback or the seller will report me and take me to court. do I have to change the feedback? I give honest feedback.

I could do without this hassle and stress as I'm having problems with the pregnancy and most likely will deliver a prem baby.

Ignore them.

Forward their messages to ebay. See what they say.

And no. Don't change your feedback! Other people rely on that!

ok - ebay have given you a no fault refund from their own coffers - they have not given you the sellers money, so she is wrong demanding anything from you. Tell her to check her paypal

The threats of court and feedback - don't you dare worry about it or relent, she is again totally wrong and blowing hot air - you are absolutely right, feedback is your opinion and it is not anything which would be dealt with in court. Her threats are utterly groundless, do not let her bully you!

If the messages are coming via ebay scroll down and you an report each message - and you can also go to ebay live chat.

I would reply once with the following, dunno if it seems a bit harsh but you don't need the hassle do you?

Dear seller

The refund was paid by ebay as a no fault refund - it was paid from their money, not yours. As such, I am not expected to return the damaged item, please check with ebay to confirm this. I also suggest you check your paypal account as you still have my money.

Secondly, I will not retract my feedback. Your threats have been reported to ebay, and if you make any further contact I will have no alternative but to report your harassment to the police,
