Mortgages and Maintenance

Is it the case that if children are young and still living in marital home which has a joint mortgage, that xh would have to continue paying his half of mortgage on top of 20% child maintenance or does the mortgage have to be paid out of that 20%?

Nothing is automatic. It depends on a whole list of factors, for which you'll need professional advice.

Usually if you are talking about an ex on an average rather than a high wage the mortgage would be expected to come from the person living there as the ex would need to fund somewhere for themselves & kids to stay too.

Well it depends, because courts will also consider his needs for a place whare he could live and his children can stay overnight.

If he has a huge salary and his housing needs are sorted, then yes, he may be asked to contribute to the mortgage.

But if he doesn't have the resources to pay your mortgage and a place for him to live, you might be asked to sell the house.

Courts are about levelling the ground for both of you, if there are resourced to stay in the house, great. If not... Well part of moving on I suppose.
