To be raging at Toyota

Try to keep this short as i can. Car being having accelerator issues which causes it to stick every so often. Has happened a couple of times, the last time with DD5 and DS1 in car when it stuck on roundabout and i sped round, nearly causing an accident. Started complaining to Toyota about it and they've fobbed me off each time saying 'take out your mats', 'its the cold weather', blah blah. Then this recall happened and they booked car in and gave me a hire car which i felt much safer in. Car got looked at and they acknowledge there is an accelerator sticking issue, but not the same issue as is covered by vehicles in the recall (although end result is the same). They've ordered the part which will take until mid-March to arrive and in the meantime have told me to drive the faulty car as they only provide these to people affected by recall. Contacted head office who agreed with garage saying they were 'drawing a line under this matter', whatever that means! I'm enraged that they're willing to let me drive a car with a known dangerous problem, especially as i have 2 young kids who are regularly in car with me....

How old is the car? Did you buy it direct from garage you now talking too?

Not saying either of these things make a big difference just trying to work out what your rights might be.

I own a Toyota that will be recalled too. I've had no problems so am not in a hurry and trust my local garage to do a good job. I suppose if it's not a recall related thing they are under no more obligation to provide you with a courtesy car than they would for any other type of major breakdown. However how do you know that your problem not related to recall? Seems too coincidental.

They're saying it is cable related rather than whatever recall is fixing....

although if you look at toyota website, my make and model is showing as being covered under recall...when i queried this with garage they said it only applies to cars made at certain locations, and my car was made at an 'ok' location (???)

Can you ask for a fault checklist and a repair check list and a statement that the car is safe to drive [say for your insurance to prove it is not a recall fault if they ask] while waiting for the part. If they have to put something in writing it might change their attitude as they are saying car is safe, I would be like you hopping mad how dare anyone endanger someones life esp that of a young child, failing that as ScreaminEagle has said contact your insurance company Good luck with it all

It's long ago since I was a service manager in a dealership but I would have said the same I'm afraid. Provided the fault is not one involved in the recall and not under your warranty, the situation is that you have a vehicle which is in need of repair and that if you want the repair carried out you will have to pay for it. A loan car is normally offered if it is part of a warranty/breakdown agreement or recall agreement or a guesture if goodwill (ie if the dealer has screwed up, tbh).

Put it this way, if you needed, say, a clutch replaced, which was wear and tear or just beggared, you'd have to pay for it and make other transport arrangements. The same applies here.

If you feel that the matter IS one of design fault or error on the part of the techs at the dealership then I'd suggest you get a second opinion at another dealership, mentioning nothing of your current dispute. You will have to pay labour charges for such a "check and report" though, and remember that they should under trading law do NOTHING further to your car without giving you a price and getting your permission.
